OFFICIAL RULES


NO PURCHASE NECESSARY TO ENTER OR WIN THIS PRIZE DRAW.

These are the official rules that govern how the Microsoft FABLE II XBOX 360 PRO Prize Draw promotion will operate. This promotion will be referred to as the "Prize Draw" throughout the rest of these rules. In these rules, "we," "our," and "us" refer to Microsoft Corporation, the sponsor of the Prize Draw. “You” refers to an eligible Prize Draw entrant.


1.    WHAT ARE THE START AND END DATES?

This Prize Draw entry period starts at 12:01 a.m. Greenwich Mean Time (GMT) on May 12, 2009, and ends at 11:59 pm GMT on June 12, 2009 ("Entry Period").

Please visit http://www.worldtimeserver.com/, or similar time zone calculator, to determine local time.

Entries must be received within the Entry Period to be eligible.


2.    CAN YOU ENTER?

You are eligible to enter this Prize Draw if you are at least 17 years of age and meet the following requirements at time of entry:

  • You are a legal resident of an eligible geography and 17 years of age or older at time of entry; and

  • You are NOT an employee of Microsoft Corporation or an employee of any Microsoft subsidiary; and

  • You are NOT involved in any part of the administration or execution of this Prize Draw; and

  • You are NOT an immediate family member (defined as parent, sibling, spouse, child regardless of where they live) and do not reside in the same household as a Microsoft employee, an employee of a Microsoft subsidiary, or a person involved in any part of the administration or execution of this Prize Draw.

If you are eligible for this Prize Draw (i.e., 17 years of age or older), but are considered a minor in your place of residence, you should ask your parent’s or legal guardian’s permission prior to submitting an entry in this Prize Draw.

This Prize Draw is void in the Province of Quebec, Canada.

This Prize Draw is void in Cuba, Iran, North Korea, Sudan and Syria, and wherever prohibited by law.


3.    HOW DO YOU ENTER?

o You will automatically earn one (1) entry, when you go to
http://community.lionhead.com/win, and register for the Lionhead.com community web site as instructed. NOTE: Lionhead.com community web site registration is free. In order to register for the web site, you’ll need a Windows LIVE ID. To obtain a Windows LIVE ID for free, go to: http://get.live.com/

o Limit one (1) entry per person and e-mail address. We are not responsible for entries that we do not receive for any reason, or for entries that we receive, but are not decipherable for any reason.

We will automatically disqualify:

  1. Any incomplete or illegible entry; OR

  2. Any entries that we receive from you that are in excess of the entry l limit described above.

4.    WHAT ARE THE PRIZES?

One (1) Grand Prize. A prize package consisting of:

• A custom Fable II Xbox 360 console (NTSC) autographed by Peter Molyneux
• An copy of the Fable II video game autographed by Peter Molyneux

The total Approximate Retail Value of all prizes is: $359.98. Limit one (1) prize per person.

If the prize is unavailable for any reason, Sponsor reserves the right to award a substitute prize of equal or greater value.

If you are selected as a potential winner:

  1. You may not exchange your prize for cash or any other merchandise or services;

  2. You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, we will award it to an alternate potential winner; and

  3. If you accept a prize, you will be responsible for all applicable taxes related to accepting the prize, if any; and

  4. And are a minor (being under the age of majority) in your place of residence we may award the prize to your parent/legal guardian on your behalf.

Unless otherwise noted, all prizes are subject to their manufacturer’s warranty and / or terms and conditions.


5.    HOW ARE WINNERS SELECTED AND NOTIFIED?

At approximately June 15, 2009, we, or a company acting under our authorization, will select one (1) potential Grand Prize Winner a random drawing from all eligible entries received.

If you are a potential winner, we will notify you by mail using the contact information provided on your winning entry. If the prize/prize notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, we may award the prize to an alternate randomly selected winner.

If there is a dispute as to who is the potential winner, we will consider the potential winner to be the authorized account holder of the e-mail address used to enter the Prize Draw.

If you are a potential winner, we may require you to sign a Declaration of Eligibility and Liability/Publicity Release. If you are a potential winner and if you are a minor in your state/province/country of residence, we may require your parent or legal guardian to sign all required forms on your behalf. If you do not complete the required forms as instructed and/or return the required forms within the time period listed on the winner notification message, we may disqualify you and select an alternate winner.

For residents of Canada (excluding Quebec): If you are a potential winner, you will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by either telephone or email. If you answer the skill-testing question incorrectly, as determined by us in our sole discretion, you will be disqualified and, at our discretion, an alternate winner shall be chosen from among all remaining eligible entries.


6.    WHAT ARE YOUR ODDS OF WINNING?

Your odds of winning depend on the number of eligible entries we receive.


7.    WHAT OTHER CONDITIONS ARE YOU ARE AGREEING TO BY ENTERING THIS PRIZE DRAW?

By entering this Prize Draw you agree:

  1. To abide by these Official Rules;

  2. To the extent allowable under applicable law, to release and hold harmless Microsoft and its respective parents, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss, damage, right, claim or action of any kind arising from or in connection with this Prize Draw or any prize won, save for residents of the United Kingdom, and France with respect to claims resulting from death or personal injury arising from Microsoft’s negligence and for residents of the United Kingdom with respect to claims resulting from the tort of deceit or any other liabilities that may not be excluded by law;

  3. That Microsoft’s decisions will be final and binding on all matters related to this Prize Draw; and

  4. That by accepting a prize, Microsoft may use your name and place of residence online and in print, or in any other media, in connection with this Prize Draw, without payment or compensation to you. The declaration of eligibility, use, indemnity and liability/publicity release provided to the potential winner (pursuant to clause 5 above) will make reference to obtaining your free consent to use your name and place of residence. In any case, the lack of such consent does not prevent the winner from receiving the prize.


8.    WHAT LAWS GOVERN THE WAY THIS PRIZE DRAW IS EXECUTED AND ADMINISTRATED?

This Prize Draw will be governed by the laws of the United States and the State of Washington, and you consent to the exclusive jurisdiction and venue of the courts of the State of Washington, United States for any disputes arising out of this Prize Draw.

For residents of the United Kingdom only: The provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.


9.    WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE PRIZE DRAW CAN’T RUN AS PLANNED?

If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and / or integrity of this Prize Draw, we reserve the right to cancel, change or suspend this Prize Draw unless to do so would be prohibited by law and subject to any written directions from a regulatory authority. This right is reserved whether the event is due to human or technical error or Act of God. If a solution cannot be found to restore the integrity of the Prize Draw, subject to any directions from a regulatory authority, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Prize Draw. If you attempt to compromise the integrity or the legitimate operation of this Prize Draw by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future Promotions, so please play fairly.


10.    HOW CAN YOU FIND OUT WHO WON?

We will post the names of confirmed winners online after June 16, 2009, at http://community.lionhead.com . This list will remain posted for at least thirty (30) days.


11.    WHO IS SPONSORING THIS PRIZE DRAW?

12.    PRIVACY

Microsoft’s Privacy Policy will apply to this Prize Draw and to all information that we receive from your entry. Please note that by accepting the Official Rules you are also accepting the terms of the Privacy Policy.
